Terms and Conditions
1. Information on how to enter and prizes forms part of these Terms and Conditions of entry. Employees and their immediate families of the Promoter and agencies associated with this Promotion are ineligible to enter.
2. Entry into the Promotion commences at 8.00 am (ACDT) 18th March 2022 and closes at 5.00pm (ACDT) 3rd of April 2022 (“Promotional Period”).
3. The Promoter is S. Smith & Son Pty Ltd ACN 007 871 427 of 40 Eden Valley Road, Angaston South Australia 5353, trading as The Yalumba Wine Company (Yalumba) (“Promoter”).
4. For the purposes of these Terms and Conditions, the Promoter includes all related and subsidiary companies, past and present officers, agents, representatives, employees and assignees of S. Smith & Son Pty Ltd.
5. Entry is free and open to Australian residents aged 18 and over (“Entrant”) who enter the Promotion to win 4 tickets to the Yalumba Chin Chin restaurant on Saturday the 7th of May 2022 (“Promotion”) in the manner stipulated in these Terms and Conditions.
6. An Entrant must complete the following steps to enter into the Promotion:
a. ‘Like’ the “Yalumba Chin Chin Bunny” post (“The Post”);
b. ‘Tag’ three friends (who they would like to take with them);
c. ‘Follow’ @yalumbawine, and @chinchin on Instagram; and
d. ‘Share’ The Post on their Instagram story.
7. Four tickets to the lunchtime session of the Chin Chin Restaurant at Yalumba on Saturday 7th of May 20222, valued at AUD$150.00 (incl. GST) (“Prize”) will be won during the Promotional Period.
8. Posts must be submitted by the individual Entrant and any automated posts will be invalid. Entries must be submitted by a public Instagram account.
9. The Promoter reserves the right to verify the validity of entries. The Promoter may, in its sole discretion, disqualify any entries from, and prohibit further participation in this Promotion by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the Promotion and reserves the right to disqualify any entry which is not submitted in accordance with these conditions of entry.
10. The Promoter takes no responsibility for late, lost or misdirected entries. Incomplete, illegible or incomprehensible entries will be deemed invalid.
11. A random draw will take place at 4.00pm (ACDT) on the 4th April 2022 to determine the winner. The judge’s decision is final and no correspondence will be entered into.
12. The winner will be notified via Instagram Messenger and asked to provide their contact information by email. The winner will be contacted within four weeks of providing their contact details. The winner will also be published on the @yalumbawine Instagram account.
13. In the event that for any reason whatsoever a winner does not respond or accept the Prize within 30 days then the Prize will be forfeited by the winner and cash will not be awarded in lieu of the Prize. A new winner will be selected and notified via Instagram.
14. The Promoter reserves the right to request the winner to provide proof of age, and proof of identity in order to claim the Prize. In the event that the winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered to the winner by the Promoter.
15. Any costs associated with use of Instagram will be the responsibility of the Entrant and Entrant agree to be bound by Instagram’s terms of use.
16. The winner will be responsible for and make their own travel arrangements to collect their Prize.
17. The Promoter shall not be liable for any loss, including but not limited to direct, indirect or consequential loss or damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with participation in this competition or accepting or utilising a Prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
18. If required to provide Content, the Entrant represents and warrants to us that they have the authority to provide all intellectual property rights related to the Content. Entrants acknowledge that their entry and all material included will be the property of the Promoter. As a condition of entering into this Promotion, each Entrant assigns all of their rights, title and interest (including copyright) in and to their entry to the Promoter from the time of entry.
19. In the case of the intervention of any outside agent or event which changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes, the Promoter may in its absolute discretion cancel the Promotion and recommence it at a later date.
20. If for any reason the Promotion is not capable of running as planned (including but not limited to) infection by computer virus, Cyber attack, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion.
21. The Promoter encourages responsible consumption of alcohol. In no way does this competition promote irresponsible consumption of alcohol. Enjoy your wine with food and alternate wine with water. Do not drink and drive.
22. This Promotion is governed by the laws of South Australia, Australia. Entrants submit to the jurisdiction of the courts of that State.
