Terms and Conditions

1. Information on how to enter and prizes forms part of these Conditions of Entry. Employees of the Promoter and agencies associated with this Promotion and their immediate families are ineligible to enter.

2. Entry into the Promotion opens at 12.00 am (ACST) 15 January 2021 and closes 11.59 pm (ACST) 30 April 2021 (“Promotional Period”).

3. The Promoter is S Smith & Son Pty Limited ACN 007 871 427 of Eden Valley Road, Angaston SA 5353 trading as Yalumba Wine Company (“Promoter”).

4. For the purposes of these Terms and Conditions, the Promoter includes all related and subsidiary companies, past and present officers, agents, representatives, employees and assigns of S Smith & Son Pty Limited ACN 007 871 427.

5. Entry is free and open to residents of Australia aged 18 and over (“Entrant”) who enter the Promotion (“Promotion”) in the manner stipulated in these Terms and Conditions.

6. An Entrant’ is defined as an eligible person who completes the following three (3) steps:


a. Purchase a bottle or glass of Yalumba Y Series at a Participating Restaurant (“Participating Restaurant”);

b.Take and post an original picture or video of their dining experience on Instagram, tagging the Participating Restaurant and @YSeriesWine, using the #TellusY hashtag; and

c. Follow the Participating Restaurant and @YSeriesWine on Instagram as a follower’.

7. A Participating Restaurant’ is defined as a venue which has agreed to take part in the competition by pouring or listing one or more Yalumba Y Series wines for the Promotional Period’. A list of Participating Restaurants’ can be found on the website www​.yalum​ba​.com

8. Photos or video content must be posted on Instagram during the Promotional Period. Only one post per person is permitted per day. Posts must be submitted by the individual entrant and any automated posts will be invalid. Entries must be submitted by a public Instagram account. Any costs associated with use of Instagram will be the responsibility of the entrant and entrants agree to be bound by Instagram’s terms of use.

9. The Promoter reserves the right to verify the validity of entries. The Promoter may, in its sole discretion, disqualify any entries from, and prohibit further participation in this Promotion by, any person who tampers with or benefits from any tampering with the entry process or with the operation of the Promotion and reserves the right to disqualify any entry which is not submitted in accordance with these conditions of entry.

10. The Promoter takes no responsibility for late, lost or misdirected entries. Incomplete, illegible or incomprehensible entries will be deemed invalid.

11. There are two Prizes to be won, one in both Queensland and New South Wales. Each Prize Pack contains one (1) $1000 beach house holiday voucher to be used in each state. Each prize pack is valued at $1,000 (“Prize”).

12. The Total Prize Pool is AUD$2,000

13. This is a game of skill and chance plays no part in the determination of the winner. Judging will be conducted by a member or members of the Promoter at 40 Eden Valley Road, Angaston at 2pm on 8 May 2021 (ACST). The judge’s decision is final and no correspondence will be entered into. The best one (1) entry per state in NSW and Queensland, determined by creative skill, will be the prize winners.

14. The winners will be notified via Instagram Messenger and asked to provide their contact information by email. The winners will be contacted within four weeks of submitting their details.

15. In the event that for any reason whatsoever a winner does not respond or accept the Prize within 30 days then the Prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the Prize. A new winner will be selected and notified via Instagram on 8 June 2021. The winner’s details will also be published on www​.yalum​ba​.com on 12 June 2021

16. The Promoter reserves the right to request winners to provide proof of age, proof of identity and proof of residency in order to claim the Prize. In the event that the winner cannot provide suitable proof, the winner will forfeit the Prize in whole and no substitute will be offered to the winner by the Promoter.

17. The Promoter shall not be liable for any loss, including but not limited to direct, indirect or consequential loss or damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with participation in this competition or accepting or utilising a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).

18. Without limiting any other provision of these Terms and Conditions, it is a condition of accepting the Prize that the winners must comply with all the conditions of use of the Prize and the Prize supplier’s requirements; and may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.

19. By providing content, the Entrant represents and warrants to us that they have the authority to provide all intellectual property rights related to the Content. Entrants acknowledge that their entry and all material included will be the property of the Promoter. As a condition of entering into this Promotion, each entrant assigns all of their rights, title and interest (including copyright) in and to their entry to the Promoter from the time of entry. Entrants consent to any use of their entry which may otherwise infringe their moral rights pursuant to the Copyright Act 1968 (Cth).

20. The Promoter will collect the Entrant’s social media tag and tagged post to record the entry. At the conclusion of the Promotion, the Promoter may request additional personal information from the Entrants to validate the winning entries. By entering the Promotion, unless otherwise advised, you also agree that the Promoter may use this information, or disclose it to other organisations that may use it, in any media for future promotional, marketing and publicity purposes without any further reference, payment or other compensation to you. To facilitate your participation, the Promoter may disclose your personal information to other companies associated with this Promotion. No other use of this information will be made without the consent of the Entrant. If you do not provide your personal information, the Promoter will not be able to award you a prize. A request to access, update or correct any information should be directed to the Promoter at its address set out below.

21. In the case of the intervention of any outside agent or event which changes the result or prevents or hinders its determination, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strikes, the Promoter may in its absolute discretion cancel the Promotion and recommence it at a later date.

22. If for any reason the Promotion is not capable of running as planned (including but not limited to) infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion.

23. The Promoter encourages responsible consumption of alcohol. In no way does this competition promote irresponsible consumption of alcohol. Enjoy your wine with food and alternate wine with water. Do not drink and drive.

24. This Promotion is governed by the laws of South Australia, Australia. Entrants submit to the jurisdiction of the courts of that State.
